These Terms of Service ("Terms") govern your use of the HabitChart web application at https://habitchart.top ("Service") and all related services provided by HabitChart ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Description of Service

HabitChart is a web application that helps users visualize the compound impact of daily micro-habits through:

- Habit creation and tracking
- Projection charts showing adopter vs. non-adopter trajectories
- Daily logging with streak tracking
- AI-powered habit recommendations and time budget optimization
- Plateau detection with personalized suggestions
- Data export capabilities (PNG charts, CSV data)
- Progressive Web App (PWA) for offline usage

2. Account Types and Access

2.1 Guest Mode

- You may use HabitChart without creating an account (Guest Mode)
- Guest mode data is stored locally in your browser's localStorage
- Guest data is not backed up and will be lost if you clear your browser data
- Guest data automatically migrates to your account if you sign up

2.2 Free Tier (Authenticated)

When you create a free account, you receive:

- Secure account with email magic link or Google OAuth authentication
- Up to 3 habits maximum
- 30-day projection horizon only
- Daily habit logging with streak tracking
- Plateau detection and suggestions
- Cloud backup of all habit data

2.3 Paid Tier (Lifetime Access)

With a one-time payment of $4.99, you receive lifetime access to:

- Unlimited habits
- All projection horizons (1 month to 50 years)
- PNG chart export with referral link
- CSV data export
- Weekly digest emails with AI-generated motivation
- Priority support

3. Payment and Billing

3.1 Pricing

- Lifetime access is available for a one-time payment of $4.99 USD
- Prices are subject to change, but existing paid users retain their access

3.2 Payment Processing

- All payments are processed securely through Stripe
- We do not store credit card information on our servers
- By purchasing, you authorize Stripe to charge your payment method

3.3 Refund Policy

- We offer a full refund within 7 days of purchase, no questions asked
- To request a refund, contact bartzalewskidev@gmail.com with your account email
- Refunds are processed within 5-10 business days
- After 7 days, all sales are final

3.4 No Subscriptions

- HabitChart uses a one-time payment model, not a subscription
- Your lifetime access will never expire or require renewal

4. User Conduct and Responsibilities

You agree to:

- Provide accurate information when creating an account
- Keep your login credentials secure
- Use the Service only for lawful purposes
- Not attempt to reverse engineer, hack, or exploit the Service
- Not use automated scripts or bots to access the Service
- Not create multiple accounts to circumvent free tier limitations
- Not share your paid account credentials with others

5. Intellectual Property

5.1 HabitChart Ownership

- The Service, including all code, design, algorithms, and content, is owned by HabitChart
- Our projection engine formulas and calculations are proprietary
- You may not copy, modify, or redistribute any part of the Service

5.2 Your Data Ownership

- You retain all rights to the habit data you create and log
- You may export your data at any time (CSV, PNG)
- By using AI features, you grant us permission to send your habit data to OpenAI for processing

6. AI Features and Limitations

6.1 AI-Powered Features

The Service uses OpenAI's API to provide:

- "Suggest for me" habit recommendations
- Tweak Wizard time budget optimization
- Plateau detection suggestions
- Weekly digest motivational narratives

6.2 AI Disclaimers

- AI-generated suggestions are for informational purposes only
- We do not guarantee the accuracy or suitability of AI recommendations
- You are responsible for evaluating and implementing AI suggestions
- AI features may be temporarily unavailable due to OpenAI API limitations

7. Data and Privacy

7.1 Data Collection

We collect and store the data described in our Privacy Policy at https://habitchart.top/privacy-policy, including:

- Account information (name, email)
- Habit data and daily logs
- Payment information (via Stripe)
- Usage analytics (privacy-focused, no personal tracking)

7.2 Data Security

- We implement industry-standard security measures
- However, no system is 100% secure. You use the Service at your own risk.
- We are not liable for unauthorized access due to circumstances beyond our control

7.3 Data Retention

- Active account data is retained indefinitely
- You may request account deletion at any time
- Deleted data is permanently removed within 30 days

8. Service Availability

8.1 Uptime

- We strive for 99.5% uptime but do not guarantee uninterrupted service
- Scheduled maintenance will be announced when possible
- The Service may be temporarily unavailable due to technical issues

8.2 Offline Mode (PWA)

- HabitChart can be installed as a Progressive Web App
- Offline mode allows logging and projections without internet
- Data syncs automatically when you reconnect

9. Termination

9.1 Termination by You

- You may stop using the Service at any time
- You may request account deletion by contacting bartzalewskidev@gmail.com
- Paid users do not receive refunds for voluntary account deletion after 7 days

9.2 Termination by Us

We reserve the right to suspend or terminate your account if you:

- Violate these Terms of Service
- Engage in fraudulent or illegal activity
- Abuse the Service or harass other users
- Create excessive load on our servers

In case of termination, you will be notified via email and given an opportunity to export your data.

10. Disclaimers and Limitations of Liability

10.1 Service "As-Is"

- The Service is provided "as-is" without warranties of any kind
- We do not guarantee that the Service will meet your specific needs
- Projection calculations are mathematical models, not guarantees of future results

10.2 No Medical or Professional Advice

- HabitChart is a productivity tool, not a medical or therapeutic service
- We do not provide health, fitness, or mental health advice
- Consult qualified professionals for health-related decisions

10.3 Limitation of Liability

- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for the Service ($4.99 maximum)
- We are not responsible for data loss due to user error or browser data clearing

11. Export Control

You agree not to export, re-export, or transfer the Service to any country or entity in violation of U.S. export laws or regulations.

12. Changes to Terms

12.1 Updates

- We may update these Terms at any time
- Material changes will be announced via email to authenticated users
- Continued use after changes constitutes acceptance of the new Terms

12.2 Notification

- The "Last Updated" date at the top will reflect the most recent changes
- You are responsible for reviewing these Terms periodically

13. Governing Law and Dispute Resolution

13.1 Governing Law

- These Terms are governed by the laws of Poland (where the developer is based)
- Any disputes will be resolved in Polish courts

13.2 Arbitration

- For U.S. users, disputes may be resolved through binding arbitration
- You waive the right to participate in class-action lawsuits

14. Miscellaneous

14.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and HabitChart.

14.2 Severability

If any provision of these Terms is found to be invalid, the remaining provisions remain in effect.

14.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

14.4 Assignment

You may not assign these Terms to anyone else. We may assign our rights to another entity.
